1. Acceptance of Terms

Welcome to datalegion.ai (the "Site"), operated by Data Legion Inc. ("Company," "we," "us," or "our"). By accessing or using this Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use this Site.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes acceptance of the modified Terms.

2. Use of the Site

You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site
• Use any automated means to access the Site or collect any information from the Site
• Interfere with or disrupt the Site or servers or networks connected to the Site
• Impersonate or attempt to impersonate the Company, a Company employee, or any other person or entity
• Use the Site to transmit any malicious code or harmful content

3. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as incidental to normal web browsing or as expressly permitted in writing by the Company.

4. Trademarks

The Company name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You may not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

5. Data Products and Services

Information about our data products and services displayed on this Site is for informational purposes only and may be updated at any time. We reserve the right to refuse service to anyone for any reason at any time.

Enterprise data products and bulk data licensing are governed by separate agreements between Data Legion and its customers. Self-serve API access is governed by these Terms, the Acceptable Data Use Policy, and the Privacy Policy.

Self-Serve Accounts

Self-serve accounts provide API access to person and company data endpoints. By creating a self-serve account, you agree to these Terms and the Acceptable Data Use Policy. Self-serve accounts include base-tier data fields. Premium fields are available for purchase on enterprise plans.

Free Trials

We may offer free trials on select API endpoints. Trials include a limited number of credits and expire after a set period. Trial data includes base-tier fields with personally identifiable information (PII) redacted. Verifying a payment method during the trial period removes PII redaction for the remainder of the trial. Trial terms (credit allowance, duration, and available endpoints) may change at any time without notice.

Credits and Pricing

Self-serve API access uses a credit-based, pay-as-you-go model. One credit equals one API call. Credits are purchased per endpoint and are not transferable between endpoints or accounts. Pricing is published on our pricing page and may be updated at any time. Price changes do not affect credits already purchased.

Purchased credits are valid for twelve (12) months from the date of purchase. Unused credits are forfeited after expiration. There is a minimum purchase requirement per endpoint, as displayed at checkout. Self-serve accounts are subject to a per-endpoint annual spend cap.

Payment Processing

Payments are processed by Stripe, Inc. ("Stripe"). By making a purchase, you agree to Stripe's terms of service. Data Legion does not store your payment card details. All payment information is handled directly by Stripe in accordance with PCI-DSS standards.

Refunds

All credit purchases are final and non-refundable. If you believe a charge was made in error, contact us at support@datalegion.ai within thirty (30) days of the transaction and we will review on a case-by-case basis.

API Keys and Account Security

You are responsible for maintaining the confidentiality of your API keys and account credentials. You must not share API keys with unauthorized parties. You are liable for all activity that occurs under your account. Notify us immediately at support@datalegion.ai if you believe your credentials have been compromised.

Rate Limits and Fair Use

API access is subject to rate limits. We reserve the right to throttle or suspend access if usage patterns indicate abuse, excessive load, or violation of these Terms or the Acceptable Data Use Policy. Enterprise customers may be eligible for higher rate limits under separate agreements.

Suspension and Termination

We may suspend or terminate your account at any time for violation of these Terms, the Acceptable Data Use Policy, non-payment, or suspected fraudulent activity. Upon termination, unused credits are forfeited and no refund will be issued. You may request account closure at any time by contacting support@datalegion.ai.

6. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

9. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be responsible or liable for any damage or loss caused by or in connection with use of any such content, goods, or services available through any such websites or services.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

12. Entire Agreement

These Terms, our Privacy Policy, and our Acceptable Data Use Policy constitute the sole and entire agreement between you and Data Legion Inc. regarding the Site and self-serve services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site. Enterprise services are governed by separate agreements.
